From February 1st through December 31st (the “Promotional Period”), Fosters Kraus – Plumbing Heating & Air Conditioning (“Sponsors”) will conduct a local Giveaway encouraging participants to enter for a chance to win prizes. To enter, during the Promotional Period, participants must either: log on to the website and fill out the online entry form, or (ii) send a standard-sized postcard hand-printed with their name, address, telephone number (including the area code) email address and birth date to: Fosters Kraus – Plumbing Heating & Air Conditioning 1040 East Post Rd., Marion Iowa 52302
To be eligible: (i) each online or mailed entry must be received no later than 11:59 p.m. CST on December 31st. All entries must be submitted in the name of an individual person. (ii) Entrant MUST own the home being entered in the giveaway and MUST reside within 10 miles of Cedar Rapids, Marion, Anamosa, or North Liberty, Iowa. (iii) Homeowner must be 18 yrs of age or older. See additional rules below.
The Giveaway Entities are not responsible for misdirected, incomplete, lost, late, illegible, undelivered, inaccurate or delayed or postage-due entries or mail, or for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Giveaway, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Giveaway, including, without limitation, errors which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prizes or in any Giveaway-related materials. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond Sponsor’s control, which corrupt the integrity, administration, security or proper operation of the Giveaway, Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Giveaway. In the event of cancellation, Sponsor reserves the right to award prizes from among all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render the entrant ineligible. All entries become the property of the Sponsor and will not be acknowledged or returned. Limit one (1) entry per person or address, regardless of the method of entry.
All entrants agree to be contacted by Fosters Kraus – Plumbing Heating & Air Conditioning via email and /or phone regarding the contest and in future communications.
Two (2) winners of an Amana Heating and Cooling System will be randomly chosen by the Sponsor on or around January 15th, 2023 from among all eligible entries received during the full Promotional Period. The decision of the judges will be final and binding in all matters. The odds of winning will depend on the total number of eligible entries received during the Promotional Period. The Winners will be confirmed by U.S. mail, e-mail, and/or telephone and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents (if any) required by the Sponsor.
Two (2) Amana heating and cooling systems will be awarded. Each Prize has an estimated value of between forty-five hundred and six thousand dollars ($4500 – $6000). No substitution of prizes or cash redemptions is permitted by the Winners. Sponsor reserves the right but is not obligated to substitute a prize (or portion thereof) of comparable value, at their sole discretion. The Winners are responsible for the reporting and payment of all taxes (if any) as well as any other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded. All prize details are at Sponsor’s sole discretion.
By entering this Giveaway, participants grant Giveaway Entities and their designees the right, unless prohibited by law, to use their names, cities, and states of residence, voices, pictures, and likenesses, without compensation, notification, or approval, for the purpose of advertising and publicizing the goods and services of the Giveaway Entities and all matters related to the Giveaway, in any manner or medium, now or hereafter known, throughout the world in perpetuity. The Winners will each be required to execute, without limitation, an affidavit of eligibility, liability release, tax acknowledgment form, and, except where prohibited by law, a liability and publicity release within five (5) business days of issuance of notification. Noncompliance within this time period of a potential Winner to respond to a notification attempt within five (5) days of such attempt may result in disqualification and, at Sponsor’s discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, or (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate winner will be selected by random drawing at the Sponsor’s sole discretion. The Giveaway Entities expressly disclaim any responsibility, and entrants agree to indemnify and hold harmless the Giveaway Entities, from and against any and all claims, actions, demands, and/or liability for injury, damage, or loss whatsoever relating to or arising in connection with participation in this Giveaway (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, technical, printing, seeding, human or other error or problem, Sponsor reserves the right to conduct a random drawing from among all eligible and valid prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. No more than the stated number of prizes per these Official Rules will be awarded.
III. Entrant MUST allow the furnace or central air system to be installed in their primary residence within the parameters of the above-named cities/towns. In the event that the entrant does not need or chooses NOT to install the central air or furnace in their home, they may DONATE either prize to a family in need. These rules further require that in the case of a ‘donation’ situation, the furnace MUST go into the recipient family’s principal residence and a representative of the recipient MUST meet in advance with a representative of Fosters Heating and Air Conditioning or Kraus Plumbing and Heating to determine the scope of work of the project and what, if any, additional costs will be incurred by the recipient.
Giveaway is open to all legal homeowners within the Cedar Rapids, Marion, Anamosa, North Liberty, Iowa area United States as described in Section 4. Entrants must be age 18 years or older. Void wherever prohibited by law. Giveaway is governed by U.S. law and subject to all applicable federal, state, and local laws and regulations. By entering the Giveaway, entrants agree to accept and be bound by all terms of these Official Rules and Regulations (“Official Rules”). No purchase is necessary to enter or win. A purchase will not improve your chances of winning.
